Mr. Kennelly tackles everyday issues facing employees, including severance packages, entering into labor agreements, discrimination, and termination warning signs, and rest/meal breaks and overtime pay.

During the first segment, Mr. Kennelly discusses the potential effects of the latest Executive Order from the White House, promising a heavier crackdown on illegal immigration. The new memo could have enormous ripple effects in California, where approximately ten percent of the workforce is undocumented.

From today’s Los Angeles Times: 

Undocumented people account for 45% of agriculture employment in California and 21% of construction workers, according to the USC Center for the Study of Immigrant Integration. Smaller but significant portions of the workforce in food service, manufacturing, hospitality and entertainment are undocumented. 

Mr. Kennelly welcomes fellow civil litigation trial attorney and mediation lawyer Eve Wagner to the program.

One of the most prominent issues in Ms. Wagner’s practice is wage and hour classification. Within that subject, many claims involve meal breaks, rest breaks, and overtime pay.

Ms. Wagner also highlights the “Ban the Box” employment legislation. The regulation, which began in Los Angeles and could soon spread throughout the state, will restrict employers from asking a job applicant about his or her criminal history during the application process. Until a conditional job offer has been made, employers are prohibited from inquiring about the topic.

There are more agencies working on behalf of employees in California than anywhere else in the country, protecting and enforcing their rights in the workplace.  Often times, however, companies will dangle a large sum of money in front of employees immediately before asking them to sign away their rights.
