Arthur Lindsey, 74, met the victim in an Acton parking lot while she was on a 30-day pass from a rehabilitation facility, said Deputy District Attorney Jon Hatami, who described in court how Lindsey allegedly preyed on his victim almost two years ago.
“The defendant is nothing more than a serial predator,” Hatami said during his opening statement. “The evidence in this case, and (evidence) based on his prior arrests, will show that.”
A parole officer making an unannounced visit allegedly found the woman unconscious at his home, according to court testimony.
The officer was alarmed due to several factors, according to testimony in court last week, as Hatami question the supervising officer who was at Lindsey’s house.
Lindsey was answering questions for the woman, who was later found to have a blood-alcohol level of 0.20, according to evidence presented in court.
Lindsey also had a prior conviction for a 1965 Indiana rape-murder for which he served 33 years. In addition, he served five years for failing to register as a sex offender.
Thomas Foster made an unannounced visit and came upon the alleged victim and then when he contacted, Larry Dorsey, the parole agent unit supervisor who initially investigated Foster’s report, according to court testimony.
Lindsey, 74, stands accused of ten charges — two felony counts of rape of an unconscious person, one felony count of oral copulations of an unconscious person, two felony counts of sexual penetration by foreign object, one misdemeanor count of resist, obstruct, delay of peace officer or EMT, one felony count of possession of firearm by a felon with three priors, two felony counts of rape by use of drugs and one felony counts of oral copulation by anesthesia or controlled substance, according to court documents.
Lindsey is facing life in prison if convicted of the Acton rape.
“The victim was a 29-year-old woman, a Santa Clarita resident,” said Hatami, who is handling the case for the District Attorney’s office. The crime occurred about 10 miles north of Shadow Pines, and the victim did not know Lindsey.
In addition to his rape-murder, he pleaded no contest to not being registered as a sex offender (on May 18, 2005), officials said. He was sentenced to four years in state prison.
Lindsey moved to Southern California in 1998, after he was released on parole for his murder sentence.
