The court made a unanimous decision to block Proposition 9 from appearing on the November ballot, writing that significant questions have been raised regarding the proposition’s validity.

“Apparently, the insiders are in cahoots and the establishment doesn’t want to find out how many people don’t like the way California is being governed,” said Tim Draper, a Silicon Valley venture capitalist and backer of the proposal. “They are afraid to know the answer as to whether we need a fresh start here in California.”

The measure, if it had passed the November vote, would have split California into three distinct states. Santa Clarita, along with the rest of Los Angeles County, would be a part of California, sandwiched between Northern California and Southern California.

The initiative had gained enough signatures in June to qualify for the ballot on November 6.

Proposition 9 was challenged in court by an environmental group, the Planning and Conservation League.

The group filed the suit to remove the “3 Californias” proposition from the ballot last week.

With the measure pulled from the November ballot, the court is expected to now fully consider the group’s legal challenge. If the court ultimately rejects the challenge, the initiative could still potentially appear on a future ballot.

“We conclude that the potential harm in permitting the measure to remain on the ballot outweighs the potential harm in delaying the proposition to a future election,” the justices wrote.

According to Draper, splitting California would allow regional communities to make better and more sensible decisions for their citizens to address the state’s most pressing issues, including the school systems, high taxes, deteriorating infrastructure and strained government.

“The whole point of the initiative process was to be set up as a protection from a government that was no longer representing its people,” Draper said. “Now that protection has been corrupted.”

If the proposition would have made it to the ballot, Californians would have voted on the following:

California: This would be considered the new state, which includes Los Angeles, Ventura, Santa Barbara, San Luis Obispo, Monterey and San Benito Counties.

Southern California: San Diego, San Bernardino, Orange, Riverside, Mono, Madera, Inyo, Tulare, Fresno, Kings, Kern and Imperial Counties.

Northern California: This would include the Bay Area and the 31 remaining counties north of Sacramento.

“Whether you agree or not with this initiative, this is not the way democracies are supposed to work. This kind of corruption is what happens in third world countries,” Draper said.
