What Is The Difference Between California Estate Planning And Elder Law?

During his latest appearance on KHTS AM-1220’s “The Senior Hour,” Randall Kaiden of Kaiden Elder Law Group, PC answered a few “Frequently Asked Questions” he often gets as a Santa Clarita elder law attorney.

The first common question Mr. Kaiden addressed was regarding a key issue that every senior should understand. That is, what is the difference between estate planning and elder law?

“I get this question all the time,” Mr. Kaiden said. “Not only do I get this question from consumers, kind of surprisingly, I get this question from professionals … which is a little bit shocking, but it also is very revealing, because it tells me how few people out there truly understand, what is elder law?”

Mr. Kaiden noted that he believes the best way to answer this question is with another related question. That is, Mr Kaiden explained, “When we’re talking about estate planning, what we’re really asking is, “What happens when I die? In other words, estate planning is mostly about wills and trusts.”

While elder law also asks and answers this question, Mr. Kaiden noted that estate planning addresses just “the very last sliver” of issues that seniors face.

“With elder law, we’re really asking the question, ‘What happens if I live and live and live?’” he explained. “What most people – and professionals – miss is that there’s all sorts of issues that affect seniors in the elder law arena, which are not addressed by estate planning.”

The four primary areas of elder care planning include healthcare, housing, financial and legal issues.

“People in their 70s come into our office, and we carry out planning which could affect them for 30 years, or more!” Mr. Kaiden explained.

A few issues Mr. Kaiden helps seniors through everyday, include:

  • How can I intelligently enhance my home and health care so that I may safely live at home for as long as possible?
  • If I can’t live in my home anymore, where is the best place for me to be living? How do I pay for my housing and long term care costs without blowing through my resources?
  • Am I going to be able to handle the continually rising costs of long term care? How can I avoid relying upon – or burdening – my loved ones with my care?
  • How can I structure my estate with an asset protection trust, so that I may qualify for certain critical public benefits, such as VA Aid & Attendance and Medi-Cal?

“These issues, in my opinion, eclipse the estate planning issues,” Mr. Kaiden highlighted. “Only after we’ve addressed the legal elder care issues do we turn our focus on the ‘who gets what’ part of a will or trust and deal with probate avoidance, tax minimization, and other related post-death issues.”
