Matthew Brendan Warner, 30, of Newhall, was convicted Tuesday of one charge of murder in the first degree, said Ricardo Santiago, spokesman for the Los Angeles County District Attorney’s office.

Before sentencing the defendant, Los Angeles County Superior Court Judge David Walgren of the San Fernando Branch heard victim impact statements from the infant’s mother and grandmother, according to a news release.

Other charges including assault on a child causing death, torture, oral copulation or sexual penetration of a child under 10 and aggravated sexual assault were be dropped at sentencing as part of a plea agreement, Santiago said.

Warner pleaded not guilty at his preliminary arraignment in March and pleaded no contest to a plea agreement and admitted a prior strike conviction on Sept. 2.

Warner’s daughter, Ellorah Warner died of blunt force trauma, according to the results of a medical examiner’s investigation.

Ellorah was discovered inside the cab of a parked truck in the 23600 block of Newhall Avenue around 7 a.m. Jan. 24, and pronounced dead at the scene, according to Lt. Holly Francisco, the homicide detective leading the investigation.

Homicide detectives said the baby’s father, Matthew Warner, led sheriff’s officials to where the body was found.

The results of the autopsy was pending a toxicology report, but the report didn’t indicate anything that would have caused the child’s death, according to Lt. Fred Corral of the Coroner’s Office.

The case was prosecuted by Julie Kramer of the county’s Victim Impact Program, which handles cases of elder abuse, child abuse, hate crimes, sex crimes, stalking and family violence.
