One Defendant In Masonic Fraternal Police Department Trial Dies, Second Has Case Dismissed

Only one of three Santa Clarita residents charged with claiming to be part of a state-sanctioned police agency called the Masonic Fraternal Police Department is set to go to trial after one of the suspects died and another had their case thrown out, officials said Tuesday.

Brandon Kiel, David Henry and Tonette Hayes appeared at a pretrial hearing on Monday, where the case against Kiel was dismissed after the judge granted a defense motion to suppress, said Ricardo Santiago, a spokesman for the Los Angeles County District Attorney.

Then, just hours after the hearing, Henry died, Santiago said. His cause of death was not disclosed.

As the only remaining defendant on the case, Hayes is scheduled for a pretrial hearing on April 29.

She faces a maximum possible sentence of two years in county jail if convicted as charged.
