Margie Mow: “Usually, the way they charge a person who is driving under the influence then involved in an accident where the victim dies is through the Watson rule, and that involves someone who has prior DUIs. When they enter a plea, part of the advisement is that if they are involved in an accident, chose to drink and drive and they’re involved in an accident, and as a result someone dies, they will be charged for murder. (Those with a prior DUI) are placed on notice that if they are involved in a DUI and an accident while under the influence, they will be charged with murder. In this case, I don’t know if she had a DUI, I don’t think that she did, but if she did have a DUI it would be grounds for murder.

(Court documents and a representative from the District Attorney’s Office indicated that Cina did not have a previous DUI, and a spokesman for the D.A. acknowledged that that was a common misconception: A person does not need to have a previous DUI charge in order to be charged with murder in a fatal-DUI collision scenario.)

Ashleigh Banfield: The owner of the bar has stated that she only bought two drinks, one for her one for her friend, and that was all they served her. If that’s true, where did she get all this alcohol?

Sgt Shoemaker: That’s still under investigation. The bar has been cooperative with us with giving information. Obviously there’s going to be more to it if she had someone buying drinks for her or if she came to the bar already intoxicated.

Cina, 21, was originally arrested on a DUI charge. But on Friday, officials with the Los Angeles County District Attorney’s office announced they would be pursuing further charges against the woman.

Cina now faces one felony count each of murder, gross vehicular manslaughter while intoxicated, driving under the influence of an alcoholic beverage causing injury and driving with a .08 percent blood alcohol content causing injury.

Toxicology reports indicate Cina had a blood alcohol content of .21 at the time of the crash, with the legal limit at .08.

“There were some open containers in the primary person’s vehicle,” said Lt. Rob Hahnlein with the Santa Clarita Valley Sheriff’s Station, confirming that they held alcoholic beverages, shortly after the crash.

Santa Clarita Valley Sheriff’s Station deputies responded to the collision on Oct. 6, after a vehicle traveling south on Golden Valley Road reportedly crossed the center median near Valley Center Drive and collided head-on into a car traveling northbound.
