Porsche attorneys are saying that the 2013 crash, that killed “Fast and the Furious” actor Paul Walker and his friend Roger Rodas, was caused by Rodas and not defects with the car, according to NBC Los Angeles reports.

“Roger Rodas’s death, and all other injuries or damages claimed, were the result of Roger Rodas’s own comparative fault,” according to a document, according to NBC Los Angeles. “Roger Rodas knowingly and voluntarily assumed all risk, perils and danger in respect to the operation or use of the subject 2005 Carrera GT, that the perils, risk and dangers were open and obvious and known to him, and that he chose to conduct himself in a manner so as to expose himself and others to such perils, dangers and risks, thus assuming all the risks involved in using and operating the vehicle.” 

Rodas’ wife Kristine Rodas, filed a lawsuit with Porsche and said in the lawsuit filed in Los Angeles Superior Court in May 2014 that a suspension failure of the 2005 Porsche Carrera GT led to her husband losing control of the vehicle before it careened into trees and a utility pole, according to an NBC article.

Walker and Rodas were killed on Nov. 30, 2013, in a single-vehicle car collision in the Valencia industrial park.

“(Roger Rodas) was driving a red Porsche Carrera GT at an unsafe speed, approximately 100+ mph, in the No. 1 eastbound lane on Hercules Street, approaching Constitution,” according to the Coroner’s Office report.

“For unknown reasons, the driver lost control of his vehicle, and the vehicle partially spun around, and began traveling in a southeast direction. The vehicle then struck a curb, and the driver’s side of the vehicle struck a tree and then a lightpost,” the report continued.

The force of the collision then spun the car around again, and the passenger’s side struck a tree and the vehicle burst into flames, according to notes from Santa Clarita Valley Sheriff’s Station, who were the investigators first on the scene.

Walker was in Santa Clarita Valley for a toy drive to benefit his nonprofit and was the passenger in the Porsche Carrera GT that Rodas was driving.

Paul Walker’s final movie, “Furious 7” is expected to premiere April 3, 2015 and his brother, Cody Walker was asked by producers of Furious to finish the remaining scenes, according to Forbes. Paul Walker’s face will be digitally superimposed onto Cody Walker’s in close up shots.

Paul Walker’s character, Brian O’Connor, is expected to be retired in the “Furious 7″ film.
