Marijuana Delivery Closer To Statewide Legalization, Santa Clarita Ordinance Still In Effect

A California agency recently approved new cannabis regulations, but a Santa Clarita ordinance prohibiting marijuana delivery is still in effect until the final state approval.

The Bureau of Cannabis Control (BCC) announced Friday that the organization is moving forward with regulations after a series of public hearings and hundreds of public comments.

The regulations need to be approved by the California Office of Administrative Law before taking effect, according to the BCC.

The proposal could impact a Santa Clarita ordinance, which prohibits the delivery of marijuana within city limits.  

“We are monitoring the progress of the regulations, “ said David Peterson, associate planner for Santa Clarita. “Currently the ordinance is still in effect.”

The cannabis guidelines were opposed by the California Police Chiefs Association and the League of California Cities, which represents over 400 local governments, including Santa Clarita.

After California voters passed Proposition 64 —  which legalized cannabis in the state — the Santa Clarita City Council passed an ordinance to prohibit the sale, cultivation, manufacturing, testing and delivery of cannabis or products containing the substance within city limits.

The new regulations “clarify” the state law, saying marijuana businesses may deliver to any private address in the state, regardless of whether the city permits actual brick-and-mortar pot shops in the jurisdiction, according to the BCC.

“Our regulations currently state that delivery of cannabis products can happen in any jurisdiction in the state — locals feel otherwise,” said Alex Traverso, spokesperson for the Bureau of Cannabis Control.

This goes against the current Santa Clarita marijuana ordinance, according to City officials.

“Any delivery services operating in Santa Clarita are in violation of the ordinance,” said Daniel Rivas, community preservation manager .“If an issue is brought to our attention, the City will start an investigation.”

If City staff find the business to be in violation of the ordinance, a $100 fine would be issued for the first offense, according to Rivas.

The fine for the second offense is set at $200 and the third offense is expected to be $500, said City staff.

Residents wanting to report businesses in violation of the ordinance can visit the city’s community preservation website here.

However, those penalties don’t appear to have prevented at least 18 cannabis delivery services from allegedly operating in the City of Santa Clarita, according to WeedMaps.com.

The delivery services, for both recreational and medical marijuana, reportedly operate in Santa Clarita from 10 a.m. to as late as 1 a.m.

The regulations are subject to the approval of the California Office of Administrative Law by Jan. 16.

If approved, the regulations could go into effect in April.

  3. When is the Santa Clarita City Council going to wake up!!! It’s a win win for the city, if you allow the pot in the city…..
    The potheads get to smoke, get the munchies, they get hungry and go out and buy food!!! Tax dollars for the city!!!!
    It can pay for the SCE lights that we are going to vote NO on!!!!

  4. CA Law states each household can grow up to 12 plants as long as the plants are not in public view. I say grow your own, cut out the middle man and SUCK IT SCV

  5. Get with the program, City Council. Pot is legal in the state of California. Deal with it. Forcing medical marijuana patients to drive to San Fernando valley is cruel. Delivery dispensaries are a necessity. And for recreational pot, dispensaries are no more than liquor stores, only for pot – which is safer than alcohol.
