Kratoms Legal Status In The United States

All over the world, people have been praising the effects of an herbal substance called kratom. Currently in a gray area in terms of FDA guidelines, kratom has seen its support swell up into the hundreds of thousands from people with prior ailments and pains that have led them down a road to addiction. Kratom is most often used by people who are recovering from opioid addiction and associated pains. It’s a plant extract that’s been used in a tea and raw form in Southeast Asia. Places like Thailand, Indonesia, and Vietnam all have a history of using this special herb for chronic pain. But in the United States, the rules and regulations are a bit more stringent. Here, we’ll explore the legal status in various states as well as in The U.S. as a whole. 

Federal 

Federally, the United States doesn’t regulate kratom as a supplement. It’s been the subject of much debate. The Drug Enforcement Agency has long been trying to get Kratom listed as a controlled substance. For what reason, nobody knows. They tend to cite leading studies to further the umbrella of “illegal” things. Because of this, you can find Kratom for Sale from locally sourced and approved import venues online. The flip side of kratom not being regulated is that it doesn’t have the same kinds of standards required of it that a drug does. There are no necessary clinical trials, and the efficacy has only really been approved through anecdotal and lower-tier analysis. The randomized trial studies have yet to conclude. But if you use a bit of common sense, especially when compared to something as devastating to the community as opioids, kratom is so low on the health risk scale that thousands use it anyway. 

State

On the state level, the legality of kratom gets a bit shakier. It sees the opposite side of the legal battle that marijuana is fighting where it’s legal on a state level but schedule 1 on the federal level. Some states make it illegal to sell or purchase kratom. These states include: 

  • Arkansas
  • Alabama
  • Wisconsin
  • Indiana
  • Rhode Island 

They reason that the availability of such a substance in places like head shops and online vendors will create an entry point for young people. It’s the same “gateway drug” argument that the federal government makes for marijuana. 

City and Local

There are strange exceptions to the state rule. Some cities have banned kratom for whatever reason, even if having a city ordinance does not prevent any kind of online sale or distribution. These cities include:

  • San Diego, CA
  • Denver, CO
  • Jerseyville, IL
  • Sarasota, FL

These city ordinances are often kept hidden from the public or pushed into obscurity under the mounding piles of other issues that each city has.

Fortunately for us, there is a growing concern over the use of opioids. People need treatment regardless. They’re not going to give up the ability to cull pain. But what they can do is search for an alternative. It’s the right of the American people to choose what they put in their bodies, granted it’s not obtained through criminal means. Kratom is not part of a criminal enterprise. It’s a ground-up plant from Indonesia, the most drug-restrictive country in the region. If they don’t see a problem with it, why do we?
