Noelle Halaby of FamilyLaw at Home first explained what it means to be a certified family law specialist.

“What that basically means is that the state bar is certifying that a lawyer particularly has experience — sophisticated experience as a family law attorney,” Halaby said. “In the state of California, anyone who is a lawyer can practice family law, so it is more expensive, probably, to have a certified family law specialist, but if you have any sophisticated issues that you need to deal with, you might want to consider whether or not that you want a regular lawyer or someone who specializes.”

Once a person in need of legal assistance with a divorce, domestic violence case or child support decides that a certified family law specialist is the right choice for them, Halaby recommends conducting interviews before making a selection.

“You really should interview lawyers, because lawyers aren’t surgeons; we don’t go into the operating room, make the decisions, you’re unconscious, and that’s it,” Halaby said. “Lawyers should be partners with their clients. They should hear them, they should strategize based upon what that person’s goals are, and they should work together.”

Throughout the interview process, Halaby advises paying special attention to the way the lawyer communicates, if they respect different points of view and if they seem interested in “fighting a battle you might want to fight.”

While some people may not want to pay for a formal consultation, doing so can be very beneficial before making a decision, according to Halaby.

“Prior to hiring someone, if you do pay for them to give you legal advice, you really are dipping your toe in the pool so you can kind of see how that person processes information and if it works for you,” Halaby said.

Lastly, Halaby encourages using personal recommendations whenever possible, and doing sufficient research if a recommendation isn’t an option.

“It’s better to have a recommendation if you can, but if you can’t, because not everybody knows lawyers or has someone who’s gone through this, then you just do your best research,” Halaby said. “In reality, what matters is how it works for you.”
