Santa Clarita Among Several Cities Named In Lawsuit Over Eviction Moratorium

The City of Santa Clarita was named the defendant, along with several other cities in Los Angeles County, in a lawsuit filed Friday for lost income due to a COVID-19 eviction moratorium. 

The landlords listed as plaintiffs in the suit filed in Los Angeles Superior Court include Casa Green Inc., Westside Habitats LLC, Brass Key Properties LLC, VSN Properties LLC,  Hollywood Lofts LLC, Streamline Properties LLC, Terraces at the Grove Inc. and Silver Swan Properties LLC.

Only one of the plaintiffs, Westside Habitats, has properties listed in Santa Clarita, with six apartment complexes in Newhall.

In addition to Santa Clarita, the lawsuit includes Los Angeles County, Beverly Hills, Santa Monica, West Hollywood, Glendale, Burbank, Agoura Hills and the City of Los Angeles, according to court documents.

The plaintiffs are seeking damages “far in excess of $300,000,” according to the suit. 

“While purportedly intending to provide relief to tenants … the ordinances and other enactments are illegal, imbalanced and significantly infringe on their constitutional rights,” the lawsuit said. “Undoubtedly, a significant percentage of the tenants who have not been paying rent will not pay back the arrearages.”

The lawsuit further argues there has been no moratorium for landlords, who still have to pay the monthly mortgage for the property. 

A City of Santa Clarita spokesperson declined to comment, citing ongoing litigation. 

In March, the Santa Clarita City Council adopted an urgency ordinance, temporarily prohibiting evictions of residential, commercial and manufactured home tenants arising from financial impacts of the COVID-19 pandemic. Then in May, the Santa Clarita City Council voted to extend the eviction moratorium and rent payback period to June 30.

“People are going to start recovering and start paying their rents in the short term,” said City Councilwoman Marsha McLean. “I would hate to see a family evicted because they could have paid their rent back over a little longer time.”

On Aug, 31, the City’s eviction moratorium expired and residents of Santa Clarita are subject to Los Angeles County’s temporary eviction moratorium.

  1. If you were a Deadbeat tenant BEFORE the Chinese Flu Hysteria, then you’ll still be a Deadbeat after as well.
    If there is no relief for property owners then shouldn’t be for renters either.

    • You do realize LA County has an unemployment rate of 17.5% one of the highest rates in the nation and CA has an unemployment rate of 13.3%. Prior to the Corona virus pandemic CA’s unemployment rate was 3.9% so this is what a lack of leadership and moral/ethical cowardice has wrought by the Trump Administration. By the way, the majority of the unemployed are not relying on other people’s money; they worked and paid into the system and now need these funds to survive. They are victims of this pandemic too as a result of Trump’s failure to take action, your lack of understanding of the situation and compassion reveal you are as ignorant as you are wrong.

      • Alice- I find your statements ironic given that the response to the virus has been primarily driven by the state governments. The federal government only assists with funds and guidance.

        If anyone is to blame for our situation in California it is our Governor. He has chosen to make it impossible to open, closed down our businesses when other states have opened, provided relief for renters but not landlords, and has been a one man wrecking crew for jobs in general (but not is Napa Valley winery, ironically). You are also wrong with regards to unemployment insurance. That is a state funded, not federally funded insurance so you cant blame the federal government there either unless you want to blame the democrats for not coming to the table for a second funding bill to fund small business and provide additional relief.

        While I agree that most of those unemployed are victims of the situation, you are wrong regarding who is at fault in California. The left pleads for protecting every person and one loss of life is too much so they lock down the economy then blames the Trump administration for the lack of jobs. And the first Federal Budget Surplus in decades was a result of Democrat Clinton. When Democrat Obama assumed office he inherited Republican George Bush’s Federal deficit of 1.4 TRILLION and the worst recession in almost one hundred years. It was Obama’s economic recovery plan that saved this nation from the brink of disaster and reduced the Federal deficit from (Bush’s) 1.4 TRILLION to 585 billion.

    BTW, under Republican Trump the Federal deficit for 2020 as of April is 3.7 TRILLION, so much for fiscal responsibility under the Republican watch. So keep spreading the bullshit and drinking the Kool-aid because the only one you are fooling is yourself.

  6. The little fish gets eaten by a larger fish who in turn is eaten by the largest fish. True, but so what?
    Renters who are financially impacted due to the coronavirus are the small fish. The landlords are the larger ones whose fate is determined by the largest fish, the BANKS. In a responsibly run country the banks would ease up during a time of extreme crisis or be forced to do so for the public good. They are the ones that must help even if it means a tiny bit less profit for their shareholders. Unrestrained capitalism is the root problem.

Call me crazy but with all the impact Covid has had the government should have stepped in and said until there is a vaccine or herd immunity renters don’t have to pay rent, home/building owners don’t have to pay their mortgage. Make it blanket rule, job or no job, hit the pause button, save money or pump it back into the economy and resume all payments with no interest or penalties once this thing is under control.

    Instead it takes months for our “leaders” to figure out if people out of work are entitled to a measly $600 bucks… Give me a break, the whole system is screwed up. It’s not a democrat or republican thing, nothing makes sense anymore. You die hard republican and democrats on this message board all sound like lunatics.

  9. It is all the game for elections. They on purpose turned tenants and landlords against each other to make it an election issue to secure votes of tenants. Obviously, landlords are minority. They do not need their 5 votes. They very cleverly shifted their responsibility to house people on the landlords. Let’s see how long they can get away with this.

The countries that have been successful getting it under control had lockdowns and required mask wearing. The populace COMPLIED. This did not happen in America. Is it the government fault for not taking it seriously and making sure all states complied? Now ask yourselves why the people of America think they don’t have to. Is this a party issue? Really? The sooner everyone takes this seriously, the sooner businesses can get back up and running. Blame whoever you want but think about the real reasons why America is having the most per capita cases and deaths. Be smart. Stop arguing and blaming. And do what is necessary to control the SPREAD of an unpredictable unplanned monster virus. Bottom line, it is up to YOU!
