Judge Continues Santa Clarita Gazette, The Signal Case To June

A judge continued a bankruptcy case involving the Santa Clarita Gazette and The Signal newspaper to June 8 at a hearing held Tuesday.

At the hearing, the judge indicated that she needed time to review the paperwork that had been submitted, which led to the postponement of the pending motions, according to Michael Berke, the Santa Clarita Gazette’s business attorney.

“I’m disappointed that the judge continued the motions,” said Doug Sutton, owner and publisher of the Gazette. “I was hoping for a quick and sure resolution to this issue, and prolonging it is added stress to my wife and I.”

In addition to issuing the continuance, the judge also decided to allow a deposition of Sutton and his wife, Jean, by the attorney representing The Signal, Scott Talkov.

At the deposition — which could happen as early as next week — the Suttons would be questioned by Talkov while under oath, which would then provide Talkov with additional information to be used during the hearing, according to Sutton.

“The court rejected the arguments of Sutton’s attorney that Mr. Sutton can refuse to appear at a deposition, instead instructing The Signal to file an emergency motion if Mr. and Mrs. Sutton refuse to be deposed under oath,” Talkov said.

Talkov continued, “The Suttons will need to testify under oath as to their alleged mistake in failing to disclose valuable assets to the creditors in their bankruptcy, which the Chapter 13 Trustee and The Signal allege was a bankruptcy fraud.”

Finally, The Signal withdrew their removal motion to bring the state case — the petition for adjudication as a newspaper — into the bankruptcy action, according to Berke.

In a joint statement, Sutton and his wife said they “continue to be flabbergasted over how The Signal is trying to infiltrate our bankruptcy without any seeming cause, but ultimately the judge will be the decision-maker on this.”
