A mistrial was declared for the second time in the case of a former Disney executive charged with lewd acts on a child, and officials are now gearing up for a potential third trial, officials said Monday.
After a second trial, a jury announced at the end of August that they could not reach a unanimous verdict in the case of Jonathan Blake Heely, who was charged with three felony counts of lewd acts with a child.
“The jury announced it was unable to reach a verdict and the judge declared a mistrial,” said Ricardo Santiago, spokesperson for the Los Angeles County District Attorney’s Office.
Heely was suspended from Disney upon the company being informed of the charges, according to a Disney spokesperson.
The allegations outline the timeline of the abuse of two victims, identified as Victim 1 and Victim 2.
Heely is alleged to have “willfully, unlawfully and lewdly committed a lewd and lascivious act upon and with the body and certain parts and members thereof (Victim 1), a child under the age of 14 years, with the intent of arousing, appealing to and gratifying the lust, passions and sexual desires of the said defendant and the said child,” according to court documents.
The complaints identified the period from June 2006 and June 2010 as the time frame of Victim 1’s alleged abuse.
Incidents involving Victim 2 are alleged to have occurred between August 2004 and August 2005, according to the criminal complaint.
Booking records reveal that Heely was released on $150,000 bail in December 2017.
Heely is set to return to court on Sept. 24 for a pretrial hearing as both parties prepare for a potential third trial, according to officials.
