A second civil complaint was filed last week alleging that a former Santa Clarita realtor drugged and sexually assaulted several women during work events.
The New York Times first reported the second lawsuit on Thursday, part of a months-long investigation into the allegations leveled against brokerage eXp Realty and several of its high-profile agents and executives, including former Santa Clarita realtor Mike Bjorkman.
The suit alleges that Bjorkman and his associate David Golden used eXp professional recruiting events to drug and sexually assault several victims during their time as agents of the company.
eXp Realty is heavily focused on recruitment with a near-MLM style structure, where agents who recruit other agents via eXp’s Revenue Share program receive a share of their commissions, as well as commissions generated by agents that their recruits had recruited.
Both Golden and Bjorkman were on the Revenue Share “upline” from the five women in the two lawsuits.
Anya Roberts, the plaintiff in the most recent case filed last Thursday, who agreed to be identified by the New York Times, met Golden in early 2020 and went on to develop what she believed to be a romantic relationship.
However, Roberts also detailed how both Goldman and Bjorkman offered her drugs on multiple occasions, including GHB, which has been referred to as a date rape drug.
Roberts went on to state that she believes she was assaulted by both Bjorkman and Roberts, according to the complaint. The suit holds both men and eXp accountable, as the status Golden held within the organization impaired her ability to realize the full extent of their criminal actions.
“I’m still struggling every day because of this,” Roberts told the Times. “I’ve lost everything.”
Ahead of the 2023 filings, Bjorkman had previously been accused of two counts of sexual assault in 2021.
The victim, identified as Jane Doe 3 in the first suit, reported that she had been sexually assaulted and believed she had been drugged after experiencing a total loss of memory after one drink, according to affidavits filed by the Las Vegas Metropolitan Police Department (LVMPD).
A Clark County judge dismissed all charges in the Las Vegas case in May 2021.
Bjorkman and Golden are confirmed to no longer work with eXp.
In early November, eXp CEO Glenn Sanford confirmed that the company had cut ties with “two bad actors” in response to an investor question during eXp’s third-quarter earnings call, as reported by Real Estate News.
In March 2023, the first complaint was amended to include Sanford and eXp recruiter Brent Grove as defendants.
eXp prominently features a Zero Tolerance Statement on their website, directly referring to the lawsuit filed in February.
“eXp takes its responsibility to foster a safe and inclusive environment very seriously. eXp has zero tolerance for abuse, harassment, or misconduct of any kind — including by the independent real estate agents who use our services. When any claim is made, we investigate the matter and decide on appropriate action as part of due process. When we learn of any behavior to the contrary, we take action to address it,” an excerpt of the statement reads.
