Lululemon Pursuit Suspects Arrested, Released After Allegedly Stealing Over $72,000 In Merchandise

A team of smash-and-grab theft suspects that stole over $72,000 worth of Lululemon and led California Highway Patrol (CHP) officers on a high-speed pursuit through Santa Clarita on Tuesday afternoon, were released from custody only 32 hours after their arrests.

Around 12 p.m. Tuesday, undercover CHP units assigned to the retail task force were monitoring the Lululemon Athletica store in Studio City, said Officer Josh Greengard, spokesperson for the CHP Newhall Area Office.

“The Lululemon store had a smash and grab theft occur,” Greengard said.

During the theft, four suspects stole an estimated $72,000 in Lululemon merchandise and fled the store in a silver Volkswagen Jetta, according to CHP incident reports.

“Newhall Units were able to locate the vehicle on the northbound I-5 around Magic Mountain Parkway,” Greengard said on Tuesday. “We attempted to pull the vehicle over and a pursuit was initiated.”

The vehicle briefly yielded, then sped off, hitting speeds of up to 125 mph, according to officials.

“As the vehicle approached the Interstate 5 at Grapevine (Road), it crashed and the suspects fled on foot. CHP officers located and arrested all four suspects,” read a CHP statement released Thursday.

Leimarian Johnson, 18 of Richmond; G’khaya Phillips, 20, of Vallejo; De’mariyonna Williams, 20, of Vallejo; and Marlo Smith Jr., 20, of Pleasant Hill were arrested in connection with the incident. All were charged with organized retail theft and grand theft. Additionally, Johnson was charged with evading a peace officer in a reckless manner.

According to arrest records, all suspects were released from custody on Wednesday due to California Penal Code Section 849(b).

As defined by the California Penal Code, 849(b) is used by law enforcement agencies throughout the State to release from custody prisoners who have been arrested for non-violent offenses in cases where:

(1) The peace officer is satisfied that there are insufficient grounds for making a criminal complaint against the person arrested;

(2) The person was arrested for intoxication only, and no further proceedings are desirable; or

(3) The person was arrested only for being under the influence of a controlled substance or drug and such person is delivered to a facility or hospital for treatment and no further proceedings are desirable.
