Marijuana In Santa Clarita Limited As California Legalization Nears

While recreational marijuana is legal statewide starting in January, Santa Clarita residents will not be able to buy their pot from the corner store.

Proposition 64 was passed by California voters in 2016, legalizing recreational cannabis in the state, the Santa Clarita City Council placed a moratorium banning the retail sale and manufacture of weed.

The city council passed an “emergency ordinance” that banned the manufacturing, distribution and retail sale of recreational pot within city limits, in Dec. 2016.

The city already bans the manufacture and retail over-the-counter sale of medical marijuana. Medical marijuana delivery services currently operate within city limits, according to city officials.

Proposition 64 allows individuals over the age of 21 to possess, use and cultivate recreational marijuana in certain amounts. An individual may possess up to 28.5 grams of non-concentrated marijuana or eight grams of marijuana in a concentrated form.

Personal cultivation will be limited to six plants under Prop 64. The plants must be grown in a private residence with written consent from the property owner. The structure must be fully enclosed and secured against unauthorized entry. The personal grows also have to abide by health and safety regulations, according to the text.

The law allows local jurisdictions to ban private outdoor marijuana cultivation, but not the complete ban private indoor cultivation of six marijuana plants or less, according to the city attorney.

Under the proposition, the California Department of Consumer Affairs, Department of Food and Agriculture, and Department of Public Health are responsible for issuing state licenses to commercial recreational marijuana businesses.

New laws are set to be implemented Jan. 1, in anticipation for the new “green rush” of cannabis in the state, according to officials.

It will be illegal to possess an open container of marijuana or marijuana products while driving, operating, or riding in the passenger seat or compartment of a motor vehicle, boat, or other vehicle used for transportation, according to Prop 64.

It is also against the law to drive under the influence under current California law, said officials.

California law has guidelines for where not to smoke marijuana, which includes being within 1,000 feet of a school or a daycare center when kids are around, or smoking while driving.

In the city of Santa Clarita, voters passed Proposition 64 with 45,464 in favor to 41,094 against in last year’s election.

  2. The herbal remedy for what ails you is cannabis. Marijuana is a racist propaganda name.

    The city promotes hard liquor. Every benefit includes a cash bar. Uptight juice heads will never learn.
