Senator Scott Wilk Votes To Put Repeal Of State Affirmative Action Ban On November Ballot

Senator Scott Wilk (R-Santa Clarita) crossed the aisle to join his Democratic colleagues in a vote to put Assembly Constitution Amendment No. 5 (ACA5) on the ballot in November, which would repeal California’s ban on affirmative action in public institutions.

If the amendment is approved by voters in November, it would reverse the effects of Proposition 209, which had been approved by voters in 1996.

“America is a democracy and in a democracy the people get to weigh in on important issues. In 1996 the voters weighed in on Proposition 209,” Wilk said. “That is a long time ago and in today’s climate, with the conversations many citizens have been having around their dinner tables the past few weeks, it is reasonable to let voters revisit this issue.”

The amendment would remove language from the state Constitution, which prohibits public universities, schools and government agencies from using race or sex in their admissions criteria, hiring and contract decisions.

The Senate vote took place Wednesday and was approved 30-10, satisfying the two-thirds requirement for amendments to the state constitution.

The vote fell primarily on party lines, as all Democrats supported the legislation while Senator Wilk was the sole Republican to do so.

“The Legislature did not vote to repeal Proposition 209; it voted to put the question to the voters on the November 2020 ballot. Now it is up to the voters to debate and decide themselves if the state should go in a different direction,” Wilk said. “That’s the democratic process and it’s healthy for us as a society.”

With the amendment’s passage in the state legislature, voters are expected to have the opportunity to put the measure into effect with a simple majority vote in November, and would not require the approval of Governor Gavin Newsom.

  1. Thank you for having the courage to cross lines. We need more people in office doing this.
    I’m thinking this needs to be rewritten to cover issues like equality in all area of all people. I don’t know why we can’t be like educators. We have the same opportunity to be educated, credentialed, paid the same
    Why can’t every business, private institutions do the same?
    Equality=Gender, Ethnic including having the knowledge & ability to do the job.

  2. Dear Senator Wilk,
    First, you need to be taught for the first time or reminded that we do NOT live in a democracy but in a republic.
    Next, if you are trying to make everyone equal then you should not support government intervention that favors one group over another. That in itself would be “unequal”.
    Does a black basketball player get four points for making a basket while the latino or white player gets only two points? No! The black player goes by the same rules but with hard work excels in the sport.
    Before you tell me that the schools in his neighborhood are not as good as the other schools you should put up the solution of school vouchers so students can pick their own school. You should pay teachers based on results and not on following a process dictated from incompetent bureaucrats.
    Job and housing discrimination are already illegal so that’s covered.
    Stop giving in to white guilt by moving toward a costly system proven to fail and try something that has not been tried.(see above)

  6. All children are GIVEN free public education from K-12 by the same credentialed teachers, many get free taxpayer paid breakfast, lunch & ? dinner! Why don’t other POC, Japanese, Koreans, Chinese, Filipinos, etc. have the same constant problems in society!?!? If the facts/truths keep getting condoned/covered-up by the Liberals, how can we help those choosing to fail in all aspects of society!?!?
