If bail is granted after a person is arrested, they have several different options to be released from jail, with the most common being cash bail or a surety bond.

Cash bail requires the arrestee to pay their entire bail amount to the court in an effort to guarantee they will make all of their scheduled court appearances.

If they follow through on these conditions, the cash is returned to them in full, but if they fail to appear in court at any point, their money is forfeited to the court.

Most people cannot afford to pay the thousands of dollars a cash bail requires upfront, and so purchasing a surety bond through a bail bonding company like All American Bail Bonds in Santa Clarita is a far more common option.

The bail agent will post the surety bond with the court to allow for the arrestee’s release from jail. In exchange for this service, the bail bonding company charges a non-refundable premium, which is 10 percent of the total bail amount in the state of California.

Through the surety bond, the bail bonding company is guaranteeing the court that they will pay the entire bail amount if the defendant fails to appear in court and cannot be located and brought back to custody within 180 days.

This gives the bail agent a vested financial interest in keeping an eye on the defendant and making sure they don’t “skip bail,” meaning they fail to appear in court.

In this case, bail is forfeited by the court and the bail agent will usually find the defendant and return them to custody.
