There are a number of state laws and regulations that bail agents must follow, and several ways to separate out a potentially fraudulent situation from a reputable bail bonding company.
For instance, a legitimate bail bonding company will never offer you a premium that is less than 10 percent of the total cost of the bail amount, according to Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita.
“In California, a 10 percent premium is mandated by state law,” she said. “Anyone who offers you a premium less than that is either not a real bail agent or is conducting their bail bonding business illegally.”

Other ways to protect yourself from fraud when buying a bail bond include asking to see the bail agent’s state-issued bail bondsman license and verifying that the bail bonding company has been accredited by the Better Business Bureau.
A certified bail agent should be able to thoroughly explain the bail bonding process, the cost of the bail bond and the contract before you sign any documents. You should also be given copies of all paperwork.
“Trust your instincts,” Chavez said. “If someone who says they are a bail agent is unwilling to answer your questions or makes you feel rushed, pressured or uncomfortable in any way, you can protect yourself from a potentially bad situation by walking away before signing anything or paying them any money.”
