Mr. Kennelly tackles everyday issues facing employees, including severance packages, entering into labor agreements, discrimination, and termination warning signs, and rest/meal breaks and overtime pay.

He opens the show by dissecting an issue that affect American citizens nationwide. Today, he analyzes the recently introduced health care bill and how it will affect everyone in different ways.

Mr. Kennelly then welcomes California mediator Peter Marx to the program via phone to discuss the legal intervention process. Litigation is incredibly expensive and disruptive, so many times lawyers will recommend mediation before filing a formal lawsuit. There are three stages in which mediation comes into play. One of the interesting times you can mediate a dispute is before a lawsuit is filed.

It is the mediation specialist’s objective to determine what each party truly wants from the mediation. During the mediation, Mr. Marx explains that all previous issues prior to the lawsuit should be laid out on the table. California evidence code has consistently held that nothing that is disclosed during the mediation session can be used in court, thereby allowing each party involved to be more comfortable and forthcoming.

Peter J. Marx has been a mediator for more than 25 years and has successfully handled hundreds of cases. Beginning after 20 years as a litigator and transactional attorney, Mr. Marx was an early adopter of mediation as a more civilized and far less expensive
and burdensome means of resolving disputes. His mediation practice, focused primarily on business, labor and employment and entertainment disputes, has also encompassed diverse areas from real estate to personal injury and family matters

About Mr. Kennelly

Dennis Kennelly has been practicing employment law for over 40 years in California. In his career he has represented both companies and individuals in a wide range of Employment Law issues. These range from gender and race discrimination to whistle-blowing and retaliation.

Mr. Kennelly’s style is creative. The vast majority of employment cases do not go all the way to a jury verdict. As such the art is setting the case in a position to settle at the terms most favorable to his clients. Mr. Kennelly’s ability to weave out of the box solutions into settlements has often created results that no one considered at the outset.

In his representation of Employees, Mr. Kennelly’s approach is pro-active. He encourages clients to involve him in problems early on so that he can guide them to solutions that minimize the likelihood of claims arising after the fact. Mr. Kennelly’s employer clients have never been sued after following his counsel.
