The Real Estate Fix With Rich Szerman
On today’s show, your host real estate expert Rich Szerman welcomes Real Estate Attorney and his wife, Jane Szerman in the studio. Jane and Rich talk about the laws affecting landlords and tenants. A new adjustment to a Tenant Protection Act in the state of California is aimed at helping curtail homelessness but Rich believes the new restrictions on landlords will only exacerbate the problem as landlords will feel the pressure to only rent to those with higher incomes, a move that he says is exactly what the state is trying to avoid. With the new law changes, there are now tenant protections, with rent caps and requiring “just cause” for evictions. Landlords are no longer able to evict a tenant should they want to sell the property, have a family member move into the home or even remodel. Tenants are legally allowed to stay in the property as long as they’re continuing to pay rent, the lease no longer expires, but this puts landlords at a disadvantage. A minimum of 15 disclosures must be in writing for the tenant, which include bed bug disclosures, lead based paint, flood and mold, fair housing, earthquake hazard disclosures and more which is separate from any lease agreement in order to be in compliance. Rich gives a quick market update, with numbers indicating that the market is starting to unfreeze, but suggests that the interest rates still need to fall a bit more and the number of available properties needs to increase, thus providing a better balance for supply and demand.
