Prosecutors said the case was a “decline to file” as of September 11, because there was not enough evidence to proceed with the case, officials said.

Davis, who was enrolled at College of the Canyons during the summer semester, was arrested in August and, as a result of the allegation, was banned from the college’s campus, according to COC spokesman Eric Harnish.

Davis was initially arrested for one count of rape by force or fear as the result of an allegation of an assault Wednesday, August 2 at around 10:45 a.m.

Detectives with the Special Victims Unit said the case is currently awaiting the processing of biological evidence, and pending the outcome of the tests being conducted, the case could either stay as a “decline to file,” or detectives could once again present the case to the District Attorney’s Office for charges.

Detectives told KHTS the processing of evidence in these cases could take as long as four months due to a backlog of investigations countywide.

A COC Cougar football recruit, Azhon Davis, 18, of Lancaster, was arrested several hours earlier on Monday, at approximately 8:55 a.m., according to law enforcement officials. His arrest records list him as 6-feet, 5-inches tall and 310 pounds, and the college is also mentioned on a Hudl recruiting page, although COC officials confirmed Tuesday he is no longer enrolled as a student.

A second case involving a COC student in an off-campus allegation is proceeding as of Friday.

Both cases are still under investigation by the Sheriff’s Department’s Special Victims Unit. If anyone has any information regarding the alleged crimes, they can contact the SVU at 661-471-1500.

  • Avoid the use of alcohol and other drugs. Be aware that some men may use alcohol as a means of coercing you to do things you may not want to do, and alcohol may enhance aggressive tendencies in males.
  • Pay attention to what is happening around you. Watch for nonverbal cues.
  • Trust your intuition. If you feel that you are being pressured in any way, you probably are and you should leave the situation.
  • Be assertive. Sometimes men interpret not responding as permission. Be direct and firm with someone who is sexually pressuring you.
  • Communicate your limits clearly and early. If you mean no, say “NO” firmly. If he persists, then leave.
  • Know your sexual desire limits. You have the right to set limits. If you are not sure what you want, it’s ok to stop and think about it.

Guidelines for men

  • It is your responsibility to know all of the forms of sexual misconduct. Touching can be a form of sexual assault.
  • Be aware of social pressures. It’s ok not to “score.”
  • Understand that the other person may not share your desire for intimate contact or for sex.
  • Don’t assume that previous sexual contact applies to the current situation.
  • If you’re unsure about your partner’s desires, then ask.
  • Don’t assume that just because a woman dresses in a sexy manner she wants to have intimate contact.
  • Remember that no means no.
