Criminal sentencing law, otherwise known as the laws that define and determine punishments for crimes, is what California’s justice system is based on, according to the Bail Resource Center & Career Academy.
There are three categories of crimes a person can be held accountable for: infractions, misdemeanors and felonies, which are separated by the seriousness of the crime.

“An infraction is the least serious crime an individual can commit, and the consequence is often a fine,” said Chavez. “The majority of California offenses, however, are misdemeanors, which are considered more serious than infractions.”
Misdemeanors are crimes such as assault, petty theft and public drunkenness, and can result in the individual being put on probation, sentenced to jail time, having to pay a fine or facing a combination of the three.
The most serious type of crime is a felony, which often results in the offender being sentenced to state prison for at least one year.
California Penal Code separates felonies into two categories: violent and serious. Violent felonies can include murder, robbery and rape, and serious felonies can include all violent felonies along with other crimes.

“Law enforcement and prosecutors are given the ability, based on their own judgement, to charge certain infractions as either a misdemeanor or a felony, or to charge misdemeanors as felonies,” explained Chavez. “These types of felonies and misdemeanors are known as ‘wobblers.’’’
