Bail Bonds In Santa Clarita: Collections, Charges Allowed By Bail Agents

According to state law, bail agents who sell bail bonds in Santa Clarita are only allowed to collect certain charges. The bail agents at All American Bail Bonds in Santa Clarita want the community to know what charges to expect when choosing a bail bonding company.

“Being aware of the charges that come with purchasing a bail bond can help tip off residents if a bail bonding company isn’t following state regulations,” said Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita. “When you choose a bail bonding company to bail your loved one out of jail, you want to make sure it’s a company you can trust.”

The California Code of Regulations defines the charges permitted during a bail transaction, according to the Bail Resource Center & Career Academy.

Permitted charges include the following:

  • The premium cost of the bond, which is 10 percent in the state of California
  • Collateral, if necessary
  • Reimbursement for “actual, necessary and reasonable” expenses to the bail agent in connection with the bail transaction (guard fees, notary fees, recording fees, long distance telephone expenses, telegram charges, travel expenses, etc.)
  • Reimbursement for “actual, necessary and reasonable” expenses to the bail agent as a result of a breach of contract by the arrestee, such as failing to appear in court
  • Listed expenses incurred within 180 days of a forfeiture of bail which is not set aside, in addition to the amount of the forfeiture

State regulations also prohibit bail agents from collecting service charges in addition to the premium cost of the bond.
