Santa Clarita Bail Bonds: If You’re Arrested At A DUI Checkpoint

More than 500 vehicles were screened in Friday night’s California Highway Patrol DUI checkpoint and zero people were arrested for driving under the influence.

“If you are caught any DUI checkpoint and made the mistake of drinking and driving under the influence, you have two choices,” said Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita. “You can sit in jail overnight or call a bail bondsman to bail you out.”

Usually, when someone is arrested for driving under the influence, they are put in jail until they sober up and are given a court date, she said.

In 1990, the U.S. Supreme Court upheld the constitutionality of sobriety checkpoints in Michigan v. Sitz, according to a National Highway Traffic Safety administration. The court

decided that the interest in reducing the incidence of impaired driving was sufficient to justify the brief intrusion of a properly conducted sobriety checkpoint. If conducted properly, sobriety checkpoints do not constitute illegal search and seizure in most states.

Law enforcement in more than three dozen states, including California, regularly hold DUI checkpoints.

“Make sure to have a designated sober driver or use a taxi service to get home,” Chavez said. “Most people would rather spend a couple extra dollars on a taxi instead of paying court fees and having a misdemeanor on their record.”

Here are some tips on how to avoid drunk driving:

  • Designated a sober driver — Many bars and restaurants offer free non-alcoholic drinks to the designated driver
  • Have someone you can call if your designated sober driver plan falls through
  • Program the phone numbers or download the app for taxi services, Uber and other rider services
  • Know your limit — Have one or two beers or drinks over the course of a couple hours and stop drinking soon enough before you have to leave
