The Eighth Amendment, written in 1791, states “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted,” according to the Legal Information Institute website. The idea of the excessive bail clause was taken from the English Bill of Rights.

“The Eighth Amendment to the U.S. Constitution requires that bail not be excessive,” said Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita. “This means that bail should not be used to raise money for the government or to punish a person for being suspected of committing a crime.”

The purpose of bail is to give freedom to someone who has been arrested until they are convicted of a crime.

The amount of bail is decided in the Los Angeles County Bail Schedule and varies by county. The bail schedule is updated every year and covers all crimes.

When you’re arrested, the arresting deputy looks up the crime that you are charged with in the bail schedule to see how much your bail should be set at.

“If you can’t afford the amount of bail on the bail schedule, you can ask a judge to lower it,” Chavez said. “Depending on the state, your request must be made either in a special bail-setting hearing or when you appear in court for the first time, usually called your arraignment.”

Some people can get out of jail “on their own recognizance”. These type of people usually have other family members living in the community, have lived in the community for many years, are employed, have little or no past criminal record or have been charged with previous crimes and has always appeared as required, Chavez said.
