Obtaining a surety bond — a type of bail bond — requires the help of a bail agent to solicit, negotiate and effect undertakings of bail on the defendant’s behalf, but the roles of the other agents on the insurance side may not be as well-known to the public.

The surety insurance company behind the bond employs both general agents and bail agents, as well as additional agents to insure the back amount of the bond, according to the Bail Resource Center & Career Academy.
The company’s general and bail agents participate in a licensing relationship with employees of the State Department of Insurance, known as bail solicitors and bail permittees.

The general agent acts as a broker between the agent and the surety company to solicit, negotiate and effect undertakings of bail on behalf of any surety insurer.
The bail agent can work for more than one agency and own, operate and manage the company, while the bail solicitor cannot.
The bail solicitor functions as an agent and is permitted to transact bail on behalf of the Department of Insurance and as an employee of the holder of a bail license, but the bail solicitor can only work for one company; however, they can collect commission.
The bail permittee provides their own surety and is permitted to solicit, negotiate, issue and deliver bail bonds.

The bail permittee doesn’t need insurance because they are independently financially responsible for putting up their own money to provide surety.
Because they are financially responsible, the bail permittee may function as a bail agent and can write a bond at any rate.
Each officer, director, stockholder and employee from a bail agency corporation must hold an individual bail agent license and a bail agency corporation may not employ a bail solicitor or permitee.
The licensing relationship is primarily governed by penal code, administrative/civil code, insurance code and local laws.
