Assembly Bill 1713, also known as Liam’s Law, aims to lower the legal drinking limit from .08 to .05.
Assembly members Autumn Burke, and Heath Flora along with Senator Jerry Hill, introduced the bill on Feb. 22 in an effort to lower the legal blood alcohol content, according to officials.
Existing law prohibits a person from driving a motor vehicle when a driver has 0.08 percent or more, by weight, of alcohol in their blood.
AB 1713 states that “the department shall immediately suspend the privilege of a person to operate a motor vehicle” if they are found to have 0.05 percent or more of alcohol in their blood.
This bill comes after the Kowal family lost their child to a drunk driver.
On Sept. 3, 2016 15-month-old Liam and his 15-year-old aunt were struck by a drunk driver in Hawthorne.
Liam’s aunt suffered non-life-threatening injuries, which she later recovered from, but Liam succumbed to traumatic brain injuries, according to officials.
Since then, Liam’s parents, Mishel and Marcus, have been working to create lasting and impactful societal change when it comes to drinking and driving.

What was the blood alcohol level of the drunk driver who killed Liam?
.12 blood alcohol
So then what’s the logic behind wanting .05?
1.2 was from the breathalyzer that was most likely calibrated incorrectly. They tested her blood and she was at .09.
So because of one family we can’t even enjoy a glass of wine with our meal when we go out. I guess the rest of us have no say as usual.
