Hacker first recommends new entrepreneurs do research about their venture online before speaking with a tax professional and consulting with an attorney.

While there may be some resources available online for new entrepreneurs to start their business on their own, Hacker stressed that consulting with professionals to ensure the business is created properly is often the best choice.

“You’re not going to get service (online), and you’re also not going to necessarily get something that’s specific for your situation as opposed to something that’s a cookie cutter boilerplate provision,” he said.  “There are different provisions in documents that have to be carefully analyzed when you’re forming a business, or in anything that you’re doing.”

For example, someone planning to form a partnership will need a partnership agreement in order to “avoid misunderstandings,” Hacker continued, and the name and content of that document varies depending on the situation.

“While you can go onto one of the websites and say, ‘Ok, I need an operating agreement,’ what you’re going to get is a boilerplate, bare bones (document) that may not really help your situation and your business,” he said.
