They will put up the money to get your loved one out of jail, and they will just need to be paid back with some interest and collateral in the mean time.

“Think of collateral as a way to ensure your loved one shows up in court,” said Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita.

Collateral can come in many forms including a client’s house, car or any form of property that has high market value as collateral.

All American Bail Bonds in Santa Clarita will rightfully return collateral properties when the case is closed, as per the contract, even if the person is found guilty of all charges.

However if the accused person skips court or fails to show up in court, the state or the bail bond company will seize and collect those properties.

Below is a list of different types of collateral:

  1. Cash: When the bail amount is small, some people choose to pay their bail in cash. When the case comes to a closure, they are able to get their money back.
  2. Citation Release: In this case, the person violated certain laws and is immediately cited by an arresting officer. The arrested person is then given a citation note, describing the violations and court date.
  3. Property Bond: The accused person or a close family relative of the accused pledges real property, such as cars or houses that has a value at least equal to or twice the total bail. If the accused person decides not to show up in court on assigned date, the state takes the property away.
  4. Immigration bond: Immigration bond is very different than other types of bail. In this case, it involves Immigration and Customs Enforcement. The arrestee of such case is not a legal immigrant of United States, thus may face deportation at the end of trial.
  5. Surety Bond: Surety bond also means surety on bond or bail bond. A third party, like a bail bond company helps to bail out the arrested out of jail. During this process, instead of paying the full bail amount, a family member or a friend of the accused only need to pay 10% of the total bail to the bail bond company. However, if the accused decide to flee from court date or disappear during trial, the bail bond company loses the whole bail amount to the state.
  6. Recognizance: When a person is arrested, he is booked and taken to jail. There is no bail involved. The person is released upon promising he would return to court. In many states, though the person is released on his own recognizance he is forbidden to leave the area until investigation is over.

Firearms, jewelry, bank account balances and pawnable items such as instruments, game systems and televisions can also be used as collateral.
