Before you can be sentenced or given a criminal record, that are a few steps in the criminal justice system that must be taken.

Law enforcement officials must first provide a report and evidence to a prosecuting attorney, who decides whether or not to file charges against the arrestee.

Once charges are filed defining the criminal allegations against the defendant, the defendant is expected to appear in court for their arraignment, where they are formally presented with the charges and their constitutional rights.

A judge will decide whether or not to grant bail and determine the bail amount by assessing if the defendant is a flight risk or a potential danger to the public. Bail is designed to help ensure the defendant will appear at all their future court dates if released from custody.
