Regardless of the charge, a defendant must be granted a bail hearing in front of a judge to determine if the facts are evident, the presumption of guilt is great, and/or the risk of the defendant skipping bail and taking flight is great.
The judge also has the discretion to deny bail in cases of capital crimes and flight risk.
If a defendant is charged with a capital crime such as murder, in which the penalty could be life in prison without parole or even death, a judge could deny bail — even if the plaintiffs (the prosecutor or the government) have agreed not to seek the death penalty.

In federal court, the Bail Reform Act of 1984 allows judges to deny bail to a defendant if a judge believes a defendant poses a danger to the rest of the community if freed pending trial.
In determining if a defendant is a danger to the community, a judge considers factors including the type of crime, the evidence against the defendant, and the defendant’s personal history and character.

A defendant may offer evidence that he or she is not a danger to the community, but if the judge is not convinced, bail may be set very high or denied altogether.
