On this episode of The Real Estate Fix with Rich Szerman, Rich welcomes special guest Lou Esbin, bankruptcy attorney to discuss bankruptcy & zombie seconds.

Rich introduces a new segment of the show, “Bad Bank of the Week”. Rich highlights a bank that hasn’t been behaving very well, Rich said.

This week’s highlight is RTR, they are a loan servicer. and Rich talks about his case where his client had a loan originating in April of 2006 for $80.500. It was paid for a couple of years then it went unpaid and now that amount has swollen to $173,600.

“A loan that received payments for a good 5-6 years and then sat with nobody doing anything to it has swollen dramatically,” Rich said. “We approached RTR and told them our client made payments, have good equity in their house, we would like to save their home, how do we go about doing this. What options do they have, would can we possibly do?”

After a back and fourth for weeks, RTR came back with a deal in writing however was missing the amount owed or the interest rate and the term.

Rich welcomes Lou Esbin to the show and asks Esbin a user submitted question about possibly filling for bankruptcy in order to save his home and assets.
